Atat in Rom\u00e2nia, cat si in cadrul Uniunii Europene, legislatia a trebuit adaptata rapid pentru a raspunde noilor cerinte generate de munca la distanta.<\/p>\n<p>In Romania, telemunca a fost reglementat\u0103 initial prin Legea nr.81\/2018, care a fost ulterior modificata prin legislatie ulterioara (OUG nr.192\/2020, OUG nr.36\/2021). Modificarile, impuse de necesitatile curente in care din ce in ce mai multi angajatori si salariati apeleaza la telemunca, au urmarit in general simplificarea procesului de trecere la telemunca, facandu-l mai rapid si mai putin birocratic precum si clarificarea aspectelor legate de responsabilitatile angajatorilor pentru sanatatea si securitatea telesalariatilor.<\/p>\n<p>Conform reglementarilor legale aplicabile, telemunca este definita ca fiind \u201eforma de organizare a muncii prin care salariatul, in mod regulat si voluntar, isi indeplineste atributiile specifice functiei, ocupatiei sau meseriei pe care o detine in alt loc decat locul de munca organizat de angajator, folosind tehnologia informatiei si comunicatiilor\u201d. <em><i>&#8220;the form of work organization through which the employee, on a regular and voluntary basis, fulfills the specific duties of the function, occupation or job that he holds in a place other than the place of work organized by the employer, using information and communication technology&#8221;.<\/i><\/em><\/p>\n<p>Uniunea Europeana a raspuns, de asemenea, nevoii de flexibilitate sporita in reglementarea telemuncii. Desi reglement\u0103rile specifice variaza de la un stat membru la altul, Directiva (UE) 2019\/1152 privind conditiile de lucru transparente si previzibile in Uniunea Europeana incurajeaza accesul la forme de munca flexibile. Directiva stabileste ca toti lucratorii au dreptul la un program de lucru predictibil si la o comunicare clara a acestuia de catre angajator.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/legalts.ro\/wp-content\/uploads\/2024\/05\/banner-practice-areas-telework.jpg\" alt=\"This image has an empty alt attribute; its file name is banner-practice-areas-telework.jpg\" \/><\/p>\n<h4><strong><b>Provocari specifice si solutii adoptate:<\/b><\/strong><\/h4>\n<ul>\n<li><b><span><\/span><\/b><strong><b>Sanatate si securitate la locul de munca<\/b><\/strong>: in Romania, angajatorii trebuie sa se asigure ca telesalariatii beneficiaza de un mediu de lucru sigur si sanatos, conform reglementarilor existente, ceea ce poate include efectuarea de evaluari de risc specifice la domiciliul telesalariatului;<\/li>\n<li><b><span><\/span><\/b><strong><b>Confidentialitate si protec\u021bia datelor<\/b><\/strong>: implementarea GDPR a pus un accent suplimentar pe securizarea datelor gestionate de catre telesalariati.
